WILL OF ELIZABETH (Smith) BRESSEY: PROB 11/2225

This is the last Will and Testament of me Elizabeth Bressey of No 122 Tyssen Place,

Kingsland Rd, in the Parish of St Leonard Shoreditch in the County of Middlesex, widow, first I direct that all my just debts funeral and testamentary expenses be fully paid and satisfied by my creditors hereinafter named with all convenient speed after my decease whereas I am possessed of or entitled to certain stock or funds now standing in the joint names of myself and my son John Bressey in the books of the Governor and Company of the Bank of England and which said stock or funds although so now standing in the joint names of myself and my said son is or are in my own separate exclusive and absolute stock or funds or property now I do hereby give and bequeath unto my daughter in law Mary Ann Bressey the widow of my late son Thomas Bressey now deceased the sum of two hundred pounds stock three pounds per cent Reduced Bank Annuities part of the said stock or funds so now standing in the joint names of myself and my said son in the books of the Governor and Company of the Bank of England to and for her own absolute use and benefit and I give and bequeath unto my said son John Bressey and my son in law James Trigg my executors hereinafter named and to the surviver of them and the executors or administers of such surviver the sum of one thousand pounds stock three pounds per cent reduced Bank Annuities further part of the said stock or funds so now standing in the joint names of myself and said son in the Books of the Governor and Company of the Bank of England upon the trusts following that is to say upon trust that they my said trustees and executors do and shall immediately after my decease invest the said sum of one thousand pounds stock in three pounds per cent in Bank annuities in their joint names in similar or other stock funds or securities of and in the Bank of England and upon trust that they my said trustees and executors or the survivor of them or the executors or administrators of such survivor do and shall from time to

 

time when and as the interest or dividends shall become his and payable upon or in respect of the said last mentioned sum of one thousand pounds stock three per centum reduced Bank Annuities receive such interest or dividends and pay the same sum to and into the proper hands of my Grand daughter Margaret Edgar now residing with me the daughter of my late daughter Margaret Edgar now deceased formerly the wife but afterwards the widow of John Edgar also now deceased for and during the term of her natural life to and for her own sole separate and particular use and benefit and do hereby will and direct that all such interest or dividends shall be free from and independent of and shall not be liable to the debts caused or engagements of any husband with whom my said Grand daughter shall or may at any time intermarry and I direct that the receipt or receipts of my said Grand daughter signed by her alone notwithstanding any coverture shall be a good valid and sufficient discharge and acquittance or good valid and sufficient discharges and acquaintances to my said trustees and executors for all and every sum or sums of money which in any or every such receipt or receipts shall be expressed to have been received and such receipt or receipts so signed by my said Grand daughter above shall be as valid and effectual to all intent and purposes as if she my said Grand daughter was sole and unmarried and from and immediately after the decease of my said Grand daughter upon trust that they my said Trustees and executors or the survivor of them or the executors or administrators of such surviver do and shall pay or transfer the said Capital sum of one thousand pounds Stock three pounds per centum Reduced Bank Annuities unto between amongst all and every the child or children of my said Grand daughter Margaret Edgar lawfully begotten and who shall be living at the time of the decease of their Mother share and share alike if more than one as tenants in common and if but one child then the whole to such one or only child dies in that my said Granddaughter shall depart this life with out leaving any child or children her surviving then I will and direct that the said capital sum of one thousand pounds stock three pounds per cent in reduced Bank Annuities shall fall into and be and become a part and parcel of and subject to the gift or bequest of any residuary estate as accordingly And as to for and concerning all the rest residing and remainder of any Estate and Effects whatsoever and whether real or personal and wheresoever the same may be situate lying or being or what nature hind or quality soever the same may be or consist with there and every of their rights members and appurtenances and which I shall or may be possessed of or be entitled to or interested in at the time of my decease I do hereby give devise and bequeath the same and every part and parcel thereof unto and equally to be divided between my said son John Bressey and my daughter Elizabeth Trigg the wife of the said James Trigg their heirs executors administrators or assigns absolutely share and share alike as Tenants in common and I do hereby nominate constitute and appoint my said son John Bressey and my said son in law James Trigg Executors of this my last Will and Testament hereby revoking and making void all or any former and every or any other Will or Wills or Testamentary dispositions by me at any time or times heretofore made or published and I do declare this only be and for my last Will and Testament In witness whereof I the said Elizabeth Bressey have to the first two sheets of this my last Will and Testament set my hand and to the third and last sheet I thereof set my hand and seal this ninth day of October in the year of our Lord one thousand eight hundred and fifty five. PROVED at London 29th January 1856 before the Worshipful William Robinson Doctor of Laws and Surrogate by the Oath of John Bressey the son one of the Executors to whom Admin was granted having been first sworn duly to Administer power reserved of making the like grant to James Trigg the other executor when he shall apply for the same.
